Programmatic Regulations

The CERP programmatic regulations specifically require the development of six program-wide guidance memoranda and pre-CERP baseline document that are consistent with the programmatic regulations, applicable law, and establish additional procedures to achieve the goals and purposes of the Plan. The guidance memoranda and pre-CERP baseline are fundamental to the integrated framework; provide direction for using the tools for planning, implementation, and evaluation; and provide assurances that the goals and purposes of the Plan will be achieved.

As part of the consultation process required by the programmatic regulations, these draft documents containing the six guidance memoranda and the pre-CERP baseline have been made available for review by agencies and the public. The USACE and the SFWMD will also consult with the South Florida Ecosystem Restoration Task Force. The USACE and the SFWMD will then complete the guidance memoranda and pre-CERP baseline and submit them to the Secretary of the Army in accordance with the programmatic regulations.

Submit Comments

The U.S. Army Corps of Engineers, Jacksonville District, has initiated a review of the programmatic regulations for the Comprehensive Everglades Restoration Plan required by section 601(h)(3)(E) of the Water Resources Development Act (WRDA) of 2000.

The first step of the review process is to scope out issues and concerns. The public is invited to review and provide comments on the final rule, originally published in the Federal Register in November, 2003. Comments are specifically requested on issues concerning the programmatic regulations, any items in the regulations that should be reviewed, or suggestions to improve the programmatic regulations. The 90-day comment period will end August 18, 2008.

PLEASE SUBMIT COMMENTS ON THE CERP PROGRAMMATIC REGULATIONS BY AUGUST 18, 2008.
